These Terms of Service constitute a legal agreement between you ("Client") and RAM TRADERS (hereinafter referred to as "the Company"). By engaging with the Company's services, you agree to the following terms:
1. Project Responsibility
- The Client is solely responsible for providing all project specifications, design preferences, and multimedia content to the Company before work begins.
- The Client must ensure the site is clear of obstructions and provide unhindered access to the construction area. The Company shall not be liable for delays or damages caused by restricted access.
2. Scope of Work
- The Company’s responsibilities include only those tasks explicitly agreed upon in the contract. Additional tasks such as landscaping, interior decoration, or custom design elements must be agreed upon separately and may incur extra charges.
- Materials supplied by the Company will remain the property of the Company until full payment is received unless otherwise stated.
- Delivery timelines are estimates and may be adjusted for unforeseen circumstances, including inclement weather, supply chain disruptions, or delays caused by third parties.
3. Client Approvals
- The Client will have 7 days to review and provide feedback on project milestones. If no feedback is received within this period, the work will be deemed accepted.
- The Client is responsible for obtaining all necessary permits and approvals as required by applicable laws and regulations unless otherwise specified in the contract. The Company may assist with this process for an additional fee.
4. Site Alterations
- The Company is not responsible for any alterations made by the Client or third parties after the project’s completion.
- Resolving issues arising from unauthorized alterations may incur additional charges.
5. Cancellation and Fees
- A cancellation fee will be charged for work completed up to the point of cancellation.
- Non-payment of fees or overdue amounts may result in legal action as per the Indian Contract Act, 1872.
6. Support and Third-Party Services
- Post-project support is available for a period of one month and covers structural inspections and minor adjustments.
- Extended support packages can be purchased based on the Client’s requirements.
- The Company shall not be liable for issues related to third-party contractors or suppliers.
- Upgrades or replacements to third-party installations are out of scope and may incur additional charges.
7. Enhancements and Billing
- Any changes to the project scope after the agreement will be billed as additional work.
- Scope changes may extend project timelines and incur extra costs.
- All fees must be paid without deductions or delays. Delayed payments may result in the suspension of work as per the Indian Interest Act, 1978.
8. Limitations of Liability
- The Company disclaims liability for:
- Damages caused by natural disasters, vandalism, or third-party negligence.
- Issues arising from pre-existing site conditions not disclosed by the Client.
- Delays due to supply chain disruptions or unforeseen events.
- The Company's liability is limited to instances of negligence causing structural defects or personal injury.
9. Approvals and Ownership
- Each project stage begins only after Client approval and payment for the prior stage.
- Ownership of completed work transfers to the Client upon final payment.
- The Company reserves the right to showcase completed projects unless explicitly requested otherwise by the Client.
10. Governing Law
- These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Uttar Pradesh.
11. Severability
- If any provision of this agreement is deemed invalid or unenforceable, the remaining provisions will remain in effect. Invalid provisions will be replaced by valid ones reflecting the original intent.
12. Modification of Terms
- The Company reserves the right to modify these Terms of Service at any time. Clients will be notified of any significant changes, and continued use of services will constitute acceptance of the modified terms.
13. Client's Acknowledgment
- By engaging with the Company’s services, the Client acknowledges that they have read, understood, and agreed to these Terms of Service.
